1868 Feb 5 - Wilkes Co.,NC - Shadrack Stanley, deceased estate: To the Honorable the judge of the said Court The Bill of Complaint of Miles Nance & Viney his wife, against Azzel Stanley, Avery Stanley, Joseph Y. Stanley; James Moore and Polly his wife, Meredith Becknell & Rebecca his wife, Seymore Landsdown & Sally his wife, and Noel Stanley children and next of kin of Shaderack Stanley decd; and William B. Transou & James Hays Humbly complaining respectfully sheweth unto your Honor that that about the year AD 1854 the said Shaderack Stanley became a Lunatic And was found so to be by a jury of twelve free-holders of Wilkes County on Inquisition had and the said William B. Transou was by the Court of Pleas & Quarter Sessions of Wilkes County appointed Guardian of the said Shaderack Stanley and accepted the said appointment, and as Guardian aforesaid proceeded to collect the personal estate of the said Shaderack Stanley, consisting of moneys, notes & accounts goods & chattels, which notes & accounts he collected, and also took into his possession the Real Estate of the said Shaderack Stanley consisting of valuable Lands situate in the County of Wilkes, and used the rents and profits of said Lands for a number of years. Your orator further sheweth that about the year AD 1857 the said Shaderack Stanley died intestate in the county of Wilkes leaving him surviving the said Defendants Azzel Stanley, Noel Stanley Avery Stanley, Joseph Y.[Young] Stanley, James Moor and Polly his wife, Meredith Becknell & Rebecca his wife, Seymore Landsdown & Sally his wife & Your Orator & oratrix, his only Heirs at Law & next of kin, and entitled to all of his real & personal that after the Death of said Shaderack Stanley the said William B. Transou was duly appointed Administrator of the estate of said Shaderack Stanley, by the Court of Pleas & Quarter Sessions of Wilkes County at the Nov. Term of said Court 1857 and entered into bond, and entered upon the execution of his said office. That as Adminstrator aforesaid the said William B. Transou returned in his hands all the Personal Estate, consisting of moneys, Notes, Goods & Chattels &c, the Rents & profits of the Lands of the said Shaderack Stanley and proceed further to sell the goods & Chattels of said estate and collect the notes and accounts to a Large amount. Your orator and oratrix further show That at (blank) Term Ad 18(blank) of Wilkes County Court the said William B. Transou obtained an order from the said Court to sell the Real Estate of the said Shaderack Stanley, concisting of a Tract of Land situate in Wilkes County adjoining the Lands of J. Estep, your orator Wesley Ball and others and containing about four hundred acres; as the said Transou falsely alleged for the payment of the Debts of the Said Shaderack Stanley, when in fact and in truth, there was then , in the hands of the said William B. Transou, as Adminstrator as aforesaid largely more than enough of the personal property belonging to the estate of the said Shaderack Stanley, to pull all of his debts and the costs of the Adminstration, and the said William B. Transou obtained an order for the purpose of getting title to the land himself your orator and oratrix further show that after the said order was so obtained, the said William B.Transou and the said James Hays entered into a conspiracy and combination, to stifle the Biding at the Sale of said Land, to prevent a fair competion among bidders at said sale, and to bid of the Land themselves at a price greatly below its value, and hold it as their own property. That in pursuance of this conspiracy and combination, it was agreed between the said William B. Transou and the said James Hays that the said James Hays should buy up a false and pretended claim against said Land, which one R. A. Stanley had set up, and which the said Transou and Hays then knew to be false and utterly worthless and that on the day of the sale, said James Hays should set up this false claim against said Land, and forbid the sale thereof, by the said Transou under the order of Court aforesaid rendered To keep persons from bidding and that the said Transou was to cry his said sale himself, and keep the said Lands, at a price greatly below their real value, to same person when he and the said Hays should proceed to bid for them your orator and oratrix further show, that, in pursuance of the said conspiracy and combination before the day of sale by said Transou, the said James Hays did buy from the said R. A. Stanley His said pretended claim against said Land for which he paid only five or six dollars. And that on the day of said sale by the said Transou, the said James Hays set up his said pretended claim, and forbid the sale by the said Transou, in the presence of the persons who had assembled to bid for said land, and that then said Transou went on to sell said Land, and cared it himself that several responsible persons made bids for said Land, which bids said Transou refused to cry, and would in fact cry the bid of no one else except the Bid of L. S. Call, whom the said Transou and the Said Hays had employed to bid of the land for them and as their agent, and that the Said Transou did ask of the said L. S. Call, who was bidding for the said Transou and the said Hays, at the sum of fifty dollars, when it was then well worth six hundred dollars, and when other good and smart men had at the said sale bid more than fifty dollars for the said land, your orator and oratrix further show that in pursuance of the said conspiracy and comberation the said Transou reported the said sale to the County Court of Wilkes County at the Feb Term AD 1859 thereof and by falsely representing to the said court the said sale was fairly made and for a fair price, procured said court to confirm the said sale, and to order title to be made to the said L. S. Call, and that then the said Transou immediately proceeded the said L. S. Call to make title to him the said W. B. Transou & the said James Hays for all the said Land, they further show that said Call purchased Said Lands at the said Sale, only as the agent of said Transou and said Hays, and further, that said Call never paid any money for said Lands or set up any claim thereto, but, as soon as he could made title to said Transou and Hays, and that they went immediately into the possession of said Lands after the said Sale, and have held them ever since, and taken the rents and profits thereof to a large amount every year, and still hold the said Lands claiming them as there own and take and enjoy the rents and profits thereof, jointly as Tenants in annum thereof each one claiming one moiety of Said Lands and have a joint deed for the same further said L.S. Call your orator and oratrix further show that they have often called upon the said William B. Transou, and requested him to come to a settlement with them of the estate of the Said Shaderack Stanley, both of his personal estate and the rents and profits of his lands which came to the hands of the said William B. Transou, both as guardian of the said Shaderack Stanley and as Adminstrator of his Estate. And to pay to your orator and oratrix their share of the clear residue remaining in his hands after deducting all lawful costs & charges with which reasonable request the said William B. Transou hath hitherto refused and still refused to comply. All of which actings and doings a contrary to Equity and good consider- and, and tend to the manifest wrong & injury of your orator and oratrix we without adequate relief save in this Honorable court where matters of this sort are cognizable and relievable, may it please your Honor to order an account to be Taken of the Estate of said Shaderack Stanley Dec. both the Personal esate and the rents and profits of the Lands which came to the hands of the said William B.
