At the Request of James Jervis the following Lease was recorded 21 May 1770. To WIT THIS INDENTURE made this Twenty Eighth day of April Anno Dom One thousand seven hundred and seventy, between Henry Claggett of Frederick County in the Province of Maryland, planter of the one part and James Jarvis of the County and Province aforesaid of the other part. Witnesseth that the said Henry Clagett for and in consideration of the Ments Covenants and Agreements here in after reserved on the part of said James Jarvis to be paid and kept (?) hath demise (?) lease and to farm let and by them present doth demise lease and to farm let onto the said James Jarvis One Hundred acres of Land situate "lying and being in Frederick County aforesaid and Included with the courses following: Beginning at the Beginning for a Tract os Land called Quince Orchard and running thence South seventy degrees West Ninety one perches South Eighteen degrees East One Hundred Seventy Nine perches North Seventy Three degrees East Ninety one perches North Twenty two degrees and half West fifty perches then with a Straight Line to the beginning.

To have and to hold the aforesaid parcel of Land onto the said James Jarvis his heirs, Executors, Administration and assigns from the Twenty day of November Ammo Do mini one Thousand seven hundred and seventy for and during the Term of Eighteen years Yielding and Paying therefore unto the Said Henry Clagett in manner and assigns six hundred pounds Crop Tobacco in Cash and four shillings Sterling Yearly and every year and the said James Jarvis for himself his heirs Executors and Administrators doth hereby Covenant and agree with the said Henry Clagett in manner and form following to Wit:

That the said James Jarvis his heirs and assigns doth agree Annually and every year to pay unto the said Henry Clagett Two hundred pounds of Tobacco for every Male Labourer imployed on the aforesaid premises Except the said James Jarvis and his male children so long as they remain under the age of Twenty one years and one other Male Tax or female Labourer and one hundred and fifty pounds of Tobacco for every Female Labourer imployed on the aforesaid Demised premises except as before excepted and the said James Jarvis his wife and female children so long as they remain under the age of Sixteen Years.

That the the said James Jarvis his heirs Executors and Administrator Shall and will well and truly pay or cause to be paid unto the said Henry Clagett his heirs or assigns the said rents and forfeitures in such manner and form as is here before appointed for payment thereof According to the true Intent and Meaning hereof without any Deduction Reduction or defalcation hereof or of any part thereof and the said James Jarvis his heirs Executors Administrator or assigns shall and will at their own proper Cost and Charges In Seven Years from the date hereof Build a good Tobacco House in Workmanship manner, Thirty two feet by Twenty two and shall Inclose the premises and such part thereof as shall be cultivated with a good strong and lawfull Fence and shall set and plant an Orchard with one hundred apple trees at Thirty feet distance from each other upon such part of the demised premises as shall be meet and Convenient for that purpose and in case of default or destruction in the Said Trees shall replace them them with others.

And further that the said James Jarvis his Executor, Administrator or Assigns shall and will at their own or his proper Cost and Charges keep in good Tenantable or fair to the said hereby demised premises and likewise the said Fence and Orchard when so made and planted and also all houses orchard and fences that have been, or shall be erected in the same during the said Term and at the end of the said term deliver unto the said Henry Clagett his heirs or assignees the Quiet and peaceable and possession of the Said demised premises with their appointments in good and Tenantable repair and that He -- May Shall permit or commit any waste or Spoil in the said Demised premises, fall any of the Timber Trees thereon growing or cut down any Wood therefrom by such as shall be necessary for the proper use and Improvement of the Land or assign Sell or Lease the said premises or any part thereof to any person whatsoever without the Licence and Consent of the said Henry Clagett his heirs and assigns for that purpose first had and obtained provide always that if it shall happen that the said Yearly Rents reserved or forforture as aforesaid or any part thereof shall be behind hand or unpaid or the said James Jarvis his Executors administration or Assigns shall fail in the performance of any matter being hereby Covenanted and agreed to be done and performed or to Suffer anything to be done to the same that from thence forth and at all times afterwards it shall and may be Lawfull for the said Henry Clagett his heirs and assigns unto the said Demised premises with their appurtenants to reenter and the same to have again retain and posses and enjoy as of his and their former Estate and all Occupiers thereof from thence to expel put out and remove anything herein to the contrary not withstanding.

In witness thereof the parties have hereunto affixed their hands and Seals the day and year above. Written, the words (and half) interlined between the sixth and seventh lines before the Sealing and delivery of these presents did likewise the words (so assign Sell or lease the said premises of any part thereof to any person whatsoever without the License and Consent of the said Henry Claget his heirs and assignees for that purpose first had and attained) between the twenty fourth and Twenty fifth Line.

The condition of the above obligation is such that a marriage is shortly expected to be soleminized and had between the above bound Lewis Mullikin & Susannah T. Jarvis. Now if their be no lawful cause to obstruct the said marriage the above obligation is to be void and otherwise to remain in full force and (due?).

Listed in the 1776 Federal Census Records, MD, Sugar Land Hundred are: Samuel Ellis, age 55, his wife Mary is 52. Their children: Samuel Ellis Jr., age 10; Cassandra, age 17; Anna age 14. In the same hundred are found: Solomon Ellis, age 32 and his wife, Margaret age 32. Children: Charles, age 4; Solomon, age 2; James, age 12; Verlinder age 12; and Martha, 10. Also living with this family is John Gibson, age 18, and one negro. ----- Move forward to 1800 Elizabeth City County, VA Tax list (VA Genealogist - Index 1-20, Volume 19, page 20 & 22) and the above names become important to Jarvis researchers. Elijah Jarvis is listed: 1 male and 3 females. On page 22, "a return of licenses granted for 1801" for Elijah Jarvis, Richard Smith, and Samuel Ellis.

Henry Claggett (1728-1777) settled in Montgomery County and owned Magruder's Chance, Quince Orchard, Addison and Clagett's Folly. He served in the Rev. as a private of Capt Richard Smith Company, Flying Camp. Will was made in Montgomery Co, July 13, 1777; proved February 2, 1778. He married Ann Magruder, dau. of Samuel Magruder and Margaret Jackson Magruder. Henry Claggett's will mentions "The land whereon widow Jarvis lives and 15 acres lying between Joseph Compton and Benjamin Holland....where William Pack lives with all remaining part of Quince Orchard which belong to me."

Beginning at a stake Lewis Mullikin's corner on John Frey's line thence along it North thirty seven chains to a stake on the Moravian line thence along it west two chains and fifty links to the Moravian corner then north eight chains to a Black Oak John Douthit's corner thence along his line west twenty chains to a white oak Peter Fry's corner thence along his line south forty five chs to Lewis Mulikin's corner thence East along his line to the beginning containing one hundred acres. This indenture made the 14th day of March in the year of our Lord 1794 between Valintine Fry of the county of Rowan and state of North Carolina of the first part and James Jarvis of the county and state aforsaid on the other part, witnesseth that for and in consideration of the sum of 70 pounds good money of the said state to him in hand paid by the said James Jarvis the wrights whereof he doth here by acknowledge and there with fully content and satisfied and he the said Valintine Fry do bargain sell, grant and make over in Fee Simple unto the said James Jarvis his hiers ------- and assigns a certain piece of land situated lying and being in the county aforsaid on the waters of Muddy Creek beginning a black oak on the Moravian line and runs south 7 chains to a post oak, thence east 40 chains to a post oak, south 43 chains to a stake ... chains to a black oak,.... chains to a stake, east 5 chains to the beginning. Containing by computation 200 acres by the same more or less. To have and to hold the said 200 acres of land all its appurtinances, privileges and improvements unto him the said James Jarvis his hiers and assigns forever and the said Valintine Fry do for himself and his hiers and asignes covent and agree to and with the said James Jarvis that he the said James Jarvis hiers -- shall and may forever hereafter peaseably and quietly have hold and occupy and posses the said bargain promise without molistation from any person or persons whatever and free of all incumbiances whatever the lawful claim of the state excepted and and the said Valintine Fry does oblidge himself his hiers and assigns VC to warrent and forver defind the said land and premises to him the said James Jarvis his hiers estate administrators forever against the lawfull claim of all persons what-so-ever. The State of North Carolina grants (#2383) at 10 pounds the 100 acres to James Jarvis 100 acres on Muddy Creek next to Lewis Mullikin, John Fry, the Moravian line, John Douthit and Peter Fry. It begins on the corner of Lewis Mulikin at a stone on the line of John Fry, goes with it north 37 chains to a stake on the Moravian line corner, north 8 chains to a black oak on the corner of John Douthit, west with his line 20 chains to a white oak on the corner of Peter Fry, south with his line 45 chains to the corner of Lewis Mullikin, then east with it to the begining.

Witenesseth that for an in considertion of the sum of $200.00 to him in had paid by the said Richard Ellis the reciept whereof he doth here by acknowledge hath granted bargain and sold unto him the said Richard Ellis a certain piece or parsal of land lying in the county of Rowan and on the waters of Muddy Creek beginning at a black oak running north only 3 chains to a post oak thense east 22 1/2 chains to a white oak sprout, thense south 43 chains to a hickory, thense west 22 1/2 chains to the begining, containing by estimation 100 acres of land be the same more or less. To have and to hold the aforsaid land and premises together with all the appurtinances there unto belong to him the said Richard Ellis his hiers and assigns forever. And the said James Jarvices doth hereby covinant and agree to and with the said Richard Ellis for himself hiers assigns to warrant and defend the lawful right and title of the said land and premises against the lawful claim or claims of any person or persons what-so-ever to him the said Richard Ellis his hiers and assigns forever in witness whereof the said James Jarvices hath here unto set his hand and afixed his seal the year and day frist above written. This indenture made the 24th day of January in the year of our Lord 1818 between Jarvis of the county of Stokes and state of North Carolina of the one part and Martin Hanes of the county of Rowan and the state aforesaid of the other part witnesseth that for in consideration of the sum of $50.00 good money of this state to him in hand paid by the said Martin Hanes the receipt whereof he does hereby acknowledge and therewith fully content and satisfied and he the said James Jarvis, does bargain sell grant and make over in feel simple unto the said Martin Hanes his exicutors and assigns a certain piece of land situated and lying in the county of Rowan and state aforesaid on the waters of Muddy Creek beginning at Samuil Peak's line and running thense west to Zadock Jarvis's line thense south to Lewis Mullican's thense east to Richard Ellis's line from there thense north to the begining containing by computation 50 acres be the same more or less. To have and to hold the said 50 acres of land with all the appurtenances privileges and improvements unto him the said Martin Hanes his hiers exicutors and administrators or assigns forever and the said James Jarvis does for himself his hiers and assigns covenant and agree to and with the said Martin Hanes that he the said Martin Hanes his hiers; shall and may forever herafter peaceably and quietly have hold occupy and posses the said bargained permises with out let or molistation from any person or persons whatsoever the lawful claim of the state excepted and the said James Jarvis does oblige himself his hiers and assigns, to warrant and forver defend the said land and premises to him the said Martin Hanes his hiers exicutors and administrators forever against the lawfull claims of all persons whatsoever in witness whereof this said James Jarvis have here unto set his hand and seal the day and year above written signed sealed and acknowledged in the presents of us.

This indenture made the 21st day of January in the years of our Lord 1826 between Samuel Jones Esquire, High Sheriff of the County of Rowan and State of North Carolina on the one part and George Hanes Jun. of the county of Davidson and state aforesaid on the other part, where as by virtue of an execution Issueing from the county court of Rowan against Jacob Shellhorn for the sum of $52.94 and the costs which said sum was recovered by John Hanes Adm. and others of the said Jacob Shellhorn as on record may appear. And whereas the said execution was directed and delivered to the said Samuil Jones Esquire high sheriff as aforesaid come anding him that of the goods and chattles lands and tenements of the said Jacob Shellhorn he should cause to be made the aforesaid sum of $52.94 and cost to satisfy the said execution with the cost thereon and the said Samuil Jones Sheriff as aforesaid in pursuance and by virture of this office and the aforesaid execution did sieze and take into his hand and custody (no goods and chattles to be found) a certain piece or parsel of land situated lying and being in said county of Rowan now Davidson bounds as follows: Begining on the line of Samuel Peak's hiers thence west to Zadock Jarvis's line thence south to Lewis Mullican's line thence east to Richard Ellis's line thence north to the begining containing 50 acres to the same more or less and the said Samuel Jones Sheriff aforesaid after due advertisement according to law did cause the said piece or parsel of land with all the appurtenances thereunto belonging to put up at public sale to the highest bidder on the 31st. day of January 1822 at which time and place the aforesaid George Hanes Jun. became the last and highest bidder at the sum of $28.50.

(Mary Peck married Jacob Shellhorn in 1806) of the county of Davidson and the state of North Carolina of the one part and Sara Jarvis (Sarah Peck Jarvis, Nathan's mother, m. 1811) of the county and state aforesaid of the second part witnesseth that whereas the said Charles Hanes executor as aforesaid hath obtained letter testimentary on the will of said Mary Shelhorn dec. and hath sold her land at public sale according to the direction of said will lying and being in the county aforesaid adjoing Thomas Hanes and other Beginning at a red oak on Hanes line runing south 7 chains and 90 links to a pine thense east 17 chains and 73 links to a white oak thense north 7 chains and 90 links to a black oak Hanes corner thense west to the begining containing 14 acres more or less and where as the said Sarah Jarvis hath become the highest and last bidder for the sum of thirty dollars ($30.00) and had not yet received a deed for the same.
